To access or use the Site, you must:

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROSS CONSTRUCTION, LLC IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Errors, interruptions, or delays

  • Loss of data, revenue, or business opportunities

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES, OR $100 IF NO PURCHASE HAS BEEN MADE.

Some states do not allow limitation of liability; in such cases, our liability is limited to the maximum extent permitted by law.

12. Third-Party Resources

The Site may link to third-party websites or resources. We are not responsible for:

  • Their content

  • Their availability

  • Their privacy practices

  • Any loss or damage resulting from use of those sites

You access third-party resources at your own risk.

13. Indemnification

You agree to indemnify and hold Ross Construction, LLC harmless from:

  • Claims

  • Damages

  • Losses

  • Liabilities

  • Costs

  • Attorney’s fees

arising from your violation of these Terms or misuse of the Site.

14. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the State of Wisconsin.

Any dispute arising from these Terms shall be resolved exclusively in Marathon County, Wisconsin.

Before pursuing litigation or arbitration, both parties agree to first attempt good-faith resolution through mediation, following procedures agreed upon by both parties.

15. Recovery of Legal Fees

The prevailing party in any legal action or arbitration relating to this Agreement is entitled to recover reasonable attorney’s fees and associated costs.

16. Severability

If any part of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Assignment

These Terms & Conditions are not transferable by you.
We may transfer or assign our rights and obligations at any time.
